AHMEDABAD: Software giant Microsoft has again moved the Gujarat high court in defence of its cloud computing services brand “Azure”, as its use by the US tech major is under challenge in a trademark suit filed by a local information technology company, Azure Knowledge Corporation (AKC).
In 2020, AKC sued Microsoft in the city civil court here for infringing on its trademark rights, contending that it has been using the device mark since 1996 and got it registered under various classes with the Trade Marks Registry.Despite knowing this, Microsoft applied for registration in 2017 for its cloud computing services brand. The companies have been locked in a legal battle for four years.
Microsoft moved HC after the trial court last month rejected its application filed under Section 124 of the Trademark Act, questioning the validity of AKC’s trademark rights.
Microsoft claimed that AKC wrongly got the trademark registered under Class 9 for computer software.
However, the trial court refused to accept this claim and rejected Microsoft’s application saying that it could not provide any grounds or reason for its claim.
